Domestic violence and abuse

 

Domestic abuse includes all kinds of behaviour that is meant to hurt or frighten someone. It can be physical, verbal, financial or emotional. There are laws to protect you and your children should you be subjected to such abuse. There are several ways we at Sproull Solicitors LLP can help including offering advice, support and information.

 

We can advise you on obtaining court orders to protect you and your children. There are two types of orders commonly applied for;

 

 

This is an order which prohibits someone from molesting you. There is no definition of molestation, it covers a wide range of behaviours. A typical order would prohibit the other person from using or threatening violence against you, or doing any act that intimidated, harassed or pestered you or a relevant child. It may also prohibit the person from coming to your home. 

The court will make a non-molestation order if it is satisfied that an order is necessary for your health, safety or wellbeing or that of children.

This is an order regulating the rights to live in a property. It can confirm your right to live at the property, regulate occupation so as to define areas of the property you can each enter, remove the other party from the property and impose an exclusion zone around the property. 

If you are suffering abuse from someone whom you are not and have not been in a relationship with you may be able to obtain protection through the Protection from Harassment Act. Harassment is defined as a course of conduct (ie conduct on at least 2 occasions) that the other party knows (or ought to know) involves harassment. You may be able to apply to the Court for an injunction order for your protection.
