Following breakdown of a relationship
Financial issues between people separating can be complex and difficult. These issues are dealt with separately from matters relating to children, divorce or dissolution of partnership procedure. At Sproull Solicitors LLP our dedicated family solicitors, who are members of Resolution (formerly Solicitors Family Law Association), endeavour to deal with these issues in a sensitive, cost effective and expeditious manner to promote negotiation and settlement by agreement if at all possible.

Upon commencing a new relationship
You may be embarking on a new relationship and require advice to safeguard your current financial circumstances. Should you wish to cohabit with your partner it is advisable to enter into a cohabitation agreement with them. This can set out not only how you will own any property or other assets, but also what your contributions to household bills will be, and what should happen in the unfortunate event of the relationship breaking down. A cohabitation agreement is not watertight but it is very difficult to say that it should not be implemented if both parties had received legal advice at the time. It is far more complicated to deal with any dispute about property where no cohabitation agreement exists as commonly there will be a disagreement as to what was intended at the start of the relationship.
If you are intending to marry or enter into a civil partnership you may wish to consider a pre-nuptial agreement setting out what you would want to happen in the unfortunate event of your marriage or civil partnership failing. Although not legally binding, it is a factor that the court would take into account in any subsequent divorce or dissolution of civil partnership proceedings, but only if the agreement was entered into at least 21 days before the marriage, both parties received independent legal advice and gave full and frank disclosure about their finances to each other.
